Hi everyone, I hope you can offer some good advice? I am a 'maman de coeur' to a Kenyan former street boy. In 2010 I founded a registered charity for helping street children i and that's where I met him. In 2014, I brought him to France even though by then he was 21 years old. He learnt the language, integrated well, enrolled in French school, made many French friends, finished the education he sadly missed in Kenya and eventually took his Baccalaureat. During his studies, he worked as often as he could so he could contribute to his upkeep. Last year, having finished his studies, he applied at the Prefecture to change his student visa to a working visa. They refused and so we consulted a lawyer who then began a legal procedure with the Prefecture. His student visa expired at the end of December 2017 while he was still waiting for the response from the Prefecture so technically he was at this stage an 'illegal' but we didn't feel so bad as his Lawyer was processing his case. The bombshell came when he was picked up by the local gendarme for a spot check (he wasn't wearing his gloves while on his scooter). His paperwork showed he was illegal. To cut a long story short, the gendarmes contacted the prefecture to check on him, his lawyer had ignored a request for further information (way back in June), they immediately put him under house arrest (with me) and have now given him a deportation order. This means his Kenyan passport has been confiscated. It has always been at the back of his mind to join the military - so finally, my question is, can he apply to the Legion without a passport? He has a Kenyan ID, birth certificate and driving licence?

First thing first: some people on this forum should seriously start considering stopping talking out of their a*se... Yes, riding a motorbike or a scooter in France without the proper (reinforced) safety gloves is an offence, like riding without a helmet... So pleaaase shut the f*ck up when you don't know :rolleyes:.
Second: Madame, what type of document is your ‘son’ having? An expired residency card? Anyway, since I understand he lives in France, it’s no big deal to travel to Aubagne and try joining with whatever document he's in possession of. Not like if he had to travel from the other side of the world and work one year to pay for the plane ticket. What will happen in the worst case scenario is that he'll be turned down at the entry gate, where they check the documents. If this happens, then he'll need to find a plan B. Half of the Chinese immigrants of Paris 13e arrondissement (Paris 'Chinatown') who joined the Legion did it without a valid Id document...
Being fit and speaking French are two important things that can help him.

Which translates, that yes you have to wear gloves while riding a scooter. In all my time in France I've never seen this applied, however it is the law. I can only suppose that it isn't applied by the police that often is because unless it is winter time, the jeunes des cités would scream out racists and ‘harcèlement’.

No problems there Rapace, we're both on the same side. I think what is important is the fact that this young man from Kenya, if he chooses to do so, needs to have some sort of ID. If he talks all his certified legal docs; Bac, carte de séjour, birth certificate, passport etc. then that should be enough. If some are not there, (passport) then it will be the legion that decides.
However, a word of warning, teeth - it's absolutely necessary that he has these checked by a dentist, he cannot afford to be told to re-apply in 3 months. There is also the I.Q. test. Although he has the Baccalauréat, I would say that it's good to see it at least once, in order to understand how the system works.

There are enough illegal Africans in Europe, we don´t need more but the Legion has always been a refuge for men who needed help. In this case staying in France & a French pass i think. I am honest in saying i am not a fan of migrants in Europe but if they take him... make him sweat for his French pass. Hard as possible.
Oh i hope you can read this before gets deleted xD (making Joe work harder in the forum).
As a foreigner or an ALIEN (!!), US style to Europe, with the only tie being that my grandparents were Italians, I can see two strong points when it comes to migration, well the two more commons points to migration.

1) Economical issues. One the main point against migration, is that it, takes away jobs from the Natives. This is a speech that is being used from the US when they talk about Mexican, to Argentina and Brazil when they talk about Venezuelans, etc. Now this is my experience in The Netherlands and what I have seen.. They are undermanned when it comes to basic jobs that pay minimal wage (1,600 euros) or shy above it. I've been working on those jobs for this last years and most if not all the workers are non Dutch and the people in charge needs MORE people and have a hard time finding them. So i wonder how many jobs are taken away from the natives, when there is no native that want they job to begin with. Plus is not like those companies are underpaying people. They do follow the law.

2) Cultural issues: here I do see a lot friction between Africans countries and European ones... Let's be honest in the American continent we don't really have culture, countries are too young and we are mostly for the money and we couldn't care much about culture.
They were allowed to carry and practice their religion and culture (of course in their countries you are not allowed to practice your own religion or culture...), even so some of these people will find any reason to complain and cry racism and complain about the culture...
A good example in the NL is Zwarte Piet... When i came to the NL for the first time 16 years ago, people didn't seem to care about it or even say it's a racist character. It was just another tradition that's celebrate in early December part of the Dutch culture. A few year (near 2012), I did start to see around December a lot of complaints that " IT IS RACIST!!! YOU ARE MOCKING MY ANCESTORS!!!".. Now talking to some Dutch, it seems that they were brainwashed to be ashamed to their culture... But in the other hand Europe had his nose in African for a long time too... In the end it will be a big problem in the future.
